Terms of Service

1. Acceptance

By creating an account or using the Fluctara platform ("Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

Fluctara provides personalised audio entrainment protocols driven by SCPN physics, biometric feedback, and clinical parameters. The Service includes a REST/WebSocket API, web application, and optional device integrations.

3. Medical Disclaimer

Fluctara is not a medical device. It is not cleared by the FDA, CE-marked, or approved by any regulatory body for the diagnosis, treatment, or prevention of any disease or medical condition. Do not use Fluctara as a substitute for professional medical advice. Consult a qualified healthcare provider before using audio entrainment if you have epilepsy, a pacemaker, a heart condition, are pregnant, or have any psychiatric condition.

4. Account Responsibilities

• You must provide accurate registration information.
• You are responsible for maintaining the confidentiality of your credentials.
• You must be at least 16 years of age to create an account.
• One account per person. Sharing accounts is prohibited.

5. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or extract the Rust engine binaries (except as permitted under AGPL-3.0).
• Use the Service to harm, harass, or endanger any person.
• Circumvent authentication, rate limiting, or security controls.
• Submit false biometric data or manipulate EVS scores.
• Use the API for automated scraping beyond documented rate limits.

6. Intellectual Property

The Fluctara source code is licensed under GNU AGPL v3.0-or-later. Commercial licensing is available for proprietary use — contact protoscience@anulum.li.

SCPN physics, EVS methodology, and SSGF geometry are original research by Miroslav Šotek. Concepts © 1996–2026. Code © 2020–2026. All rights reserved outside the AGPL grant.

7. Subscription & Billing

Free tier: limited sessions per month. Premium and Pro tiers: billed monthly in CHF via the payment processor. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds for partial periods.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.

9. Limitation of Liability

To the maximum extent permitted by law, Fluctara and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to health outcomes, data loss, or device incompatibility.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be handled per the Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Switzerland. Disputes shall be resolved in the courts of St. Gallen, Switzerland.

12. Changes

We may update these Terms. Material changes will be communicated via email to registered users. Continued use after changes constitutes acceptance.
