Terms of sale

These terms cover buying an audio session from this site. They are written to be read rather than clicked past, so they are short and they say the awkward parts out loud. They do not reduce any right the law gives you as a consumer, and where they appear to, the law wins.

Who you are buying from

Fluctara is developed within the Anulum Institute; the seller is the person, not the institute. That is stated plainly because a project name is not a party to a contract, and you are entitled to know who is. The contact address reaches a human for anything on this page.

Miroslav Šotek, trading as Fluctara — an Einzelunternehmen, which is the Swiss form for a business carried on by one named person.

Commercial register
Not entered. A Swiss sole proprietorship is required to register only above an annual turnover of CHF 100,000, and this one is below it.
VAT
The seller is not registered for value-added tax. Tax on your purchase is handled by the seller of record — see the next section.

What you are buying

A licence to one audio session, and the files that carry it. Not a subscription, not a service, and not access to something that could later be taken away: once a file is on your machine it is yours to keep under the file licence, and that stays true if this site closes.

Each purchase delivers the same session in three formats — WAV, FLAC and MP3 — at one price. They are three containers around one master, not three editions, and buying is not a choice between them.

  • What the licence lets you do, and what it does not, is set out in full on the file licence page.
  • A programme listed as ready-made is rendered before you buy it and downloads immediately.
  • A session built to order is generated after payment, so it arrives when the render finishes rather than at once.

Price and tax

Prices are published on the pricing page and depend on two things only: how long the session runs and whether video is included. The same session costs the same for everyone, and no price depends on who is asking.

Value-added tax is calculated at checkout against the country you are buying from, so the amount you pay may differ from the amount shown on the pricing page. The total is shown before you confirm, and the invoice comes from whoever is the seller of record for the transaction.

Polar. They take the payment, calculate and remit the tax due in your country, and issue the invoice, so your payment contract for the transaction is with them.
What that means for you
One party answers for the money and one for the files. Polar is the first. Everything about the session itself — what it is, whether it works, and what you may do with it — is ours, and this page is where we say so.

Payment

Payment is taken by our payment provider on a page they host. We never see your card details and never hold them; what reaches us is that a payment succeeded, for which session, and an email address to deliver it to.

If a payment fails, nothing is charged and nothing is delivered. You can try again without anything being held against the attempt.

Delivery

Delivery is a download rather than a shipment. After payment you get a link by email; it opens a page listing the files your purchase covers, and each can be downloaded and re-downloaded.

Downloads resume if a connection drops, and every file is checked against the digest recorded when it was made before a byte is sent — so a corrupted or substituted file is not delivered at all rather than delivered quietly.

Your right to change your mind

For most things bought at a distance you have fourteen days to withdraw without giving a reason. Digital content delivered immediately is the exception, and buying here asks you to accept that exception before you pay. The statutory rights notice explains exactly what you are giving up and what you keep, and it is worth reading before you buy rather than after.

Everything you keep — the right to a file that works, matches its description, and is what was advertised — is unaffected by anything on this page.

If something is wrong

Write to the contact address and say what happened. A file that will not play, does not match what the page described, or never arrived is our problem to fix, and the fix is a working file or your money back.

We would rather hear about it than have you assume it is not worth mentioning. There is no form to fill in.

If you have not downloaded it, say so within thirty days and you get your money back. No reason needed and nothing to explain: we can see whether a file was ever fetched, so you do not have to argue for it.

When access can end

A file already downloaded stays yours; nothing here reaches onto your machine. What can end is the download link and any further purchase, and that happens only where the file licence has been broken — uploading a purchased session, passing it on, or reselling it.

That ends a permission you were given. It does not entitle anyone to a refund of a purchase already completed, and it is the only circumstance in which we would do it.

Law, complaints, and these terms changing

If a complaint is not resolved by writing to us, you may take it to the consumer authority or the courts of the country you live in; buying from a trader in another country does not move that.

These terms carry a version, and the version you agreed to is the one recorded with your purchase. Changing them later does not change what was agreed when you bought.

Governing law
Swiss law, where the seller is established. If you live in the European Union, the European Economic Area or the United Kingdom, the mandatory consumer protections of your own country apply as well, and this clause does not take them from you.
